By using this website https://www.thedeutschteacher.com ("Site") or enrolling in any of our programs or services, you agree to the terms outlined below. These Terms & Conditions govern your use of our website, digital products, courses, coaching programs, and all associated services.

Please read these terms carefully. If you do not agree with them, please do not use the Site or our services.

0. Pre-Contractual Information (Art. 246a §1 EGBGB)

The following information and Terms & Conditions contain all legally required pre-contractual information for consumers (within the meaning of Sec. 13 BGB) in connection with entering into a distance contract for the provision of an online German course (digital service). This information is provided to you prior to the submission of your contractual declaration, in a form that enables you to store and reproduce it.

When booking a course these terms shall become an essential part of your contract with The Deutsch Teacher.

1. Copyright

All content, materials, and branding on this Site—including videos, PDFs, lesson materials, text, graphics, logos, downloads, and social media content—are the intellectual property of The Deutsch Teacher and are protected by German and international copyright law.

You may not copy, reproduce, modify, share, publish, upload, or distribute any materials in part or whole without express written permission. Legal action may be taken in cases of copyright infringement.

2. Intellectual Property License

Your purchase of a course or coaching program gives you a limited, non-transferable, none sublicensable, non-exclusive license for personal use only. You may not share access, re-sell, reproduce, translate, or adapt the content for your own business, teaching, or commercial use.

Violation of this license will result in immediate removal from all programs, and legal action may be taken and might result in claims for compensation.

3. Links to Third-Party Websites and Tools

Our Site may contain links to external websites or rely on third-party platforms for payments, scheduling, email delivery, or course access (e.g., Stripe, Zoom, Feacreate, Meta, TikTok) Use of such third-party platforms is governed by the respective third-party terms only. We are not responsible for the content, privacy practices, or terms of those websites. Please review their terms and privacy policies individually.

4. Testimonials

By providing a testimonial, written feedback, or sharing your progress with us (even via email or other messages), you grant The Deutsch Teacher a non-exclusive, royalty-free, worldwide right to use, reproduce, display, and publish your contribution for marketing and educational purposes across platforms such as email, Instagram, other social media channels, newsletters and our website. Your personal data will only be published in connection with your testimonial if you have expressly consented to this. That. If you’d prefer your testimonial to be used anonymously or if you wish to withdraw your consent, please let us know in writing.

5. Refund Policy

We do not offer refunds for digital courses, group programs, or private coaching packages. Your enrollment is a commitment to yourself and your learning process.

Extended Learning Guarantee

If you complete 100% of a group course (attend all live classes and complete all assignments) and do not reach the intended level of that course (A1, A2, B1, or B2), you may be eligible to retake the same level course for free, if and when it is offered again unless we have valid reasons to believe that you did not put a reasonable amount of effort into the course. This guarantee is subject to the availability of the same course and does not apply to self-paced programs or 1:1 coaching.

To qualify, you must:

- Complete all modules and assignments in the course
- Attend all live sessions and actively participate in the community
- Notify us before the course end date to request Extended Learning access

The access ends when:

- You no longer meet the eligibility criteria.
- You have completed the course for a second time.

6. Delivery of Digital Content

For the purposes of these Terms, “digital content” means data which is produced and supplied in digital form, including online courses, downloads, coaching recordings, and membership materials. Upon successful payment, you will receive access to your course materials and any coaching or live call schedules via email or through our course platform (thedeutschteacher.com / FEAcreate). Delivery begins immediately unless otherwise stated.

7. Payment Plans

The fee for the booked German course is due for payment in full within 14 days of the date on which access to the course content is provided to you. Access shall be deemed provided on the date you receive the relevant login credentials or activation link. All payments must be made using the payment methods specified during the booking process. In the event of late payment and expiry of a grace period set in writing, we reserve the right to suspend your access to the course content until full payment is received.

If you choose a payment plan, you agree to complete all scheduled payments on time. Payment plans cannot be paused or canceled once started.

8. No Guarantees

We do not guarantee fluency, confidence, test results, or any specific learning outcome. Testimonials reflect personal experiences and do not constitute a promise of success.

9. Private Coaching (One-on-One Lessons)

Purchasing a private coaching package is a commitment to scheduled participation.

- Calls must be scheduled and completed within the time period stated at the time of purchase (e.g., 3-month package = 3-month window).

- You may reschedule a session with at least 24 hours’ notice, provided the new date still falls within the redemption window.
- Missed, canceled, or rescheduled calls with less than 24 hours’ notice are forfeited.
- It is your responsibility to book sessions in advance and manage your availability.
- If your coach becomes ill or unavailable, sessions will be rescheduled. If the illness extends beyond two weeks, alternate solutions may be offered at our discretion.

10. Group Coaching & Courses

Enrollment in group programs includes access to live calls, self-paced content, and the online community for a fixed timeframe.

By enrolling, you understand:

- There are no pauses, extensions, or deferments for any reason (including illness, travel, or personal events).
- Choosing not to attend calls is your responsibility.
- Content is available only for the duration of the course.

11. Call Recordings

Live group calls may be recorded and shared with enrolled participants for review. By attending, you consent to being recorded.

Private coaching sessions are recorded only with your prior written or verbal consent and recordings are shared privately with you.

12. Inappropriate Conduct

We reserve the right to remove you from any course, coaching call, or community space (without refund) if you engage in:

- Harassment, hate speech, or discrimination
- Sexually inappropriate or offensive behavior
- Disruption of sessions
- Repeated boundary violations toward other members or the instructor

13. Technical Requirements

To access our digital content, you will need a stable internet connection and a modern device with an up-to-date browser. We are not responsible for issues caused by your device, internet connection, or third-party platform outages.

14. Limitation of Liability

Our liability for damages arising from or in connection with the provision and use of the online German course, for whatever legal reason, shall be limited as follows:

- We are liable without limitation in cases of intent or gross negligence, for injury to life, body, or health, or under mandatory statutory provisions (such as under the German Product Liability Act).

- In case of simple negligence, our liability is limited to damages arising from the breach of a material contractual obligation (cardinal duty), but in such cases, the liability is limited to the typical, foreseeable damage.

- Any further liability is excluded.

This limitation of liability also applies to our legal representatives, employees, and agents.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless  “The Deutsch Teacher” from any claims by third parties arising out of your unlawful or intentionally harmful use of the online course platform, including, in particular, the posting or sharing of unlawful content (e.g., infringing copyright, violating personal rights or defamation). This obligation does not apply if you are not responsible for the breach.

16. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. Exclusive place of jurisdiction shall be the courts of Tübingen unless mandatory statutory provisions (in particular consumer protection laws) provide otherwise.

Under German law (§36 VSBG), we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

17. Waiver of EU 14-Day Right of Withdrawal

Under EU law, you normally have the right to withdraw from purchases of digital products within 14 days. However, by enrolling in a course or coaching program on this Site:

- You expressly agree that the program will begin immediately upon purchase (before the 14-day withdrawal period ends), and
- You acknowledge that by doing so, you waive your right of withdrawal under Article 16(m) of EU Directive 2011/83/EU and Section 356(5) of the German Civil Code (BGB).

This waiver will be presented as a separate checkbox during checkout, and you must actively confirm before completing your purchase.

18. Language

These Terms & Conditions are provided in English. This contract is concluded in English.

19. Severability

If any provision in these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply in full force and effect.

20. Modifications

We may update these Terms & Conditions at any time. All changes will be posted on this page with an updated effective date. Continued use of the Site and services constitutes your acceptance of the revised terms.
